These Terms of Service (“Terms”) govern access to and use of the public Portuum website operated by PORTUUM MARITIME S.L. (“Portuum”, “we”, “us”), including the landing page and related marketing pages.

By using the website you agree to these Terms. If you do not agree, please do not use the site.

These Terms apply only to the public website. They do not govern the Portuum software-as-a-service platform, subscriptions, trials, support SLAs, data processing, or Customer workspace use.

Access to and use of the Portuum product are governed exclusively by the written contract (and related schedules) between Portuum and the Customer organisation.

Website content is provided for general information about Portuum and our offerings. We try to keep it accurate but do not warrant that it is complete, current, or error-free. Product descriptions, pricing indications, and feature lists on the website may change and are not a binding offer unless confirmed in a Customer contract or order form.

When you submit a demo request or contact form, you agree to provide accurate information and to let us use it to respond to your enquiry as described in our Privacy & Cookie Policy. Submitting an enquiry does not create a SaaS subscription or other commercial commitment unless and until a Customer contract is signed.

You must not:

• Use the website unlawfully or to infringe others’ rights;
• Attempt to gain unauthorised access to our systems or other users’ data;
• Probe, scan, or overload the website except with our prior written permission;
• Interfere with the website’s security or availability;
• Copy, scrape, or reuse website content for commercial purposes without permission.

We may block access or take other action if we reasonably believe these Terms or applicable law have been violated.

The website, branding, logos, and content are owned by Portuum or its licensors. You may view and temporarily cache pages for personal, non-commercial use. No other licence is granted. “Portuum” and related marks are trademarks of Portuum Maritime, SL.

The website may link to third-party sites. We are not responsible for their content, policies, or practices.

The website is provided on an “as is” and “as available” basis to the maximum extent permitted by law. We do not warrant uninterrupted or error-free access. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

To the maximum extent permitted by law, Portuum is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, goodwill, or data, arising from use of the public website. Portuum’s aggregate liability arising out of these Terms is limited to €100, except where mandatory law requires otherwise.

Liability related to the Portuum SaaS product is governed solely by the applicable Customer contract.

Personal data collected through the website is described in our Privacy & Cookie Policy.

These Terms are governed by the laws of Spain, without regard to conflict-of-law rules. Courts of Girona, Spain, have exclusive jurisdiction over disputes arising from use of the website, unless mandatory law requires otherwise.

We may update these Terms periodically. The “Last updated” date will change when we do. Continued use of the website after changes become effective constitutes acceptance.
